Vols' McDaniel faces grand jury

A Knoxville judge refused to lower the assault charges against Tennessee defensive tackle Tony McDaniel Wednesday. McDaniel's attorney asked that the felony charge against his client be lowered to a misdemeanor. The decision means that the charges will now be sent to a grand jury. McDaniel has been suspended from the team since his arrest in January.

A 26-year old student, Edward Goodrich, testified that his face was broken in four places and required a metal plate to be inserted as a result of McDaniel punching him during a pickup basketball game on campus.

Goodrich's testimony included the background information that the game had a lot of fouls that were disputed by members of both teams and that McDaniel reportedly said, "The next person who fouls me, I'm going to lay them out."

McDaniel's attorney said he is still trying to talk Goodrich and his family into an out-of-court settlement.
